Both members of the 2020 Democratic ticket made clear their views on Court Packing prior to the confirmation hearings of President Trump most recent Supreme Court nominee, Amy Coney Barrett.
Senator Harris (D-CA) told POLITICO, during the 2020 presidential primary campaign, that she would not rule out expanding the Supreme Court if elected president.
“We are on the verge of a crisis of confidence in the Supreme Court,” Senator Harris (D-CA) said. “We have to take this challenge head on, and everything is on the table to do that.”
To the contrary, Vice President Biden has repeatedly expressed opposition to expanding the Supreme Court.
In 1983, Biden, then a U.S. Senator from Delaware, called expanded the court a "boneheaded idea."
More recently, Biden said, during a 2020 Democratic Primary Debate, that he was firmly against packing the court.
"I would not get into court packing." Biden said. "We add three justices. Next time around, we lose control, they add three justices. We begin to lose any credibility the court has at all."
So why now is the Biden-Harris campaign playing coy with regard to their position on expanding the Supreme Court?
The answer is simple and disappointing - Politics.
With the threat of President Trump filling Ruth Bader Ginsburg's seat on the court with a far-right conservative, Biden has now apparently decided he is open to having the opportunity to expand the court and weaken its conservative bent.
When asked on October 8 if he is open to adding justices to the court, Biden said, voters will "know my opinion on court-packing when the election is over."
What? Apparently, Biden has forgotten his own words, from only a few months ago, that expanding the court will result in the court losing "any credibility" it has at all.
Expanding the court is not the answer to addressing changes to its ideological bent.
Democrats are right to be frustrated with Senator McConnell (R-KY) for refusing to hold a vote on President Obama's Supreme Court nominee, Merrick Garland.
Senator McConnell (R-KY) is proud of not following the rules, but that does not mean that Democrats should stoop to his level. The American people are far better than this.
Democrats need to focus on winning elections, voting out Senator McConnell (R-KY) and all other members of congress who do not believe the law applies to them.
